Terms of Service

These Terms of Service ("Terms") govern your access to and use of FormPH ("FormPH", "we", "us"), a software service operated by Leveraging Digital Marketing Services that helps Philippine businesses generate BIR Form 2307 (Certificate of Creditable Tax Withheld at Source) and related documents available at birformph.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & accounts

You must be at least 18 years old and authorized to act for the business you represent. You are responsible for keeping your account credentials secure and for all activity under your account.

2. The Service

FormPH parses spreadsheets you upload and produces filled PDF certificates. The Service is a document-generation tool. It does not provide accounting, tax, or legal advice, and it does not file documents with the Bureau of Internal Revenue (BIR) on your behalf. You are solely responsible for verifying the accuracy of every generated certificate and for your own tax compliance.

3. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to upload data you have no right to process;
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service;
• Resell or redistribute the Service without our written consent.

4. Plans, billing & usage limits

Paid plans (Starter, Basic, and Pro) carry monthly document limits described on our pricing page. Payments are processed by our third-party processor, PayMongo. Fees are stated in Philippine Pesos and are charged per billing period (monthly or annual). Annual plans are billed at the published annual rate. Limits and prices may change with notice. Refunds are governed by our Refund Policy.

5. Your data

Spreadsheets you upload are processed to generate your documents and are handled as described in our Privacy Policy. You retain all rights to your data and the documents you generate.

6. Intellectual property

The Service, including its software, design, and branding, is owned by Leveraging Digital Marketing Services (operating as FormPH). These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.

7. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by Philippine law, FormPH is not liable for any indirect, incidental, or consequential damages, or for any penalties, assessments, or losses arising from errors in generated documents or from your tax filings. Our total liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. Sections that by their nature should survive termination will survive.

9. Governing law

These Terms are governed by the laws of the Republic of the Philippines, and any disputes shall be subject to the exclusive jurisdiction of the courts of the Philippines.
